Five major guest-worker bills now in Congress

There are five major guest-worker bills in Congress andanother one is being proposed. Expect more because itseems like every member of Congress is falling overthemselves in a mad rush to introduce more of them.Every elected politician seems desperate to matchwilling foreign workers with cost cutting employers.

* BILL #1: Secure America and Orderly Immigration Act S. 1033
(Introduced in Senate) Sens. McCain (R-AZ) and Kennedy (D-MA) (McKennedy)

The Secretary of Labor shall direct the coordination and modification of the national system of public labor exchange services (commonly known as `America's Job Bank' ) in existence on the date ofenactment of this Act to provide information onessential worker employment opportunities available toUnited States workers and nonimmigrant workers ... *

BILL #2: Real Guest Act of 2005 H.R. 3333
(Introduced in House) Rep. Tancredo (R-CO)

The Secretary of Labor shall take any stepsnecessary to ensure that all State employment agenciesand all employers in the United States are able toacquire secure, password-protected access to theInternet-based job database provided jointly by theDepartment of Labor and State employment securityagencies and known as `America's Job Bank' in order topermit the posting of job openings throughout theUnited States. *BILL #3: Save America Comprehensive Immigration Act H.R. 2092
(Introduced in House) Rep. Sheila Jackson Lee (D-TX)

Advertise the availability of the job opportunityfor which the employer is seeking a worker in localnewspapers in the labor market that is likely to bepatronized by a potential worker for at least 5 consecutive days.

Reform Act of 2005 S. 1438
(Introduced in Senate) Sens. Kyl (R-AZ) and Cornyn (R-TX)

The employer has posted the position in anational, electronic job registry maintained by theSecretary of Labor, for not less than 30 days.

#5: President Bush's Guest-Worker Proposal of 2004
Allow all businesses to post any job in America on aninternet website and if an American doesn't take thejob in a short time the business would be issued aguest worker visa.

The White House has drawn up a comprehensive proposal to reform US immigration laws that would allow illegal immigrants already in the country to remain as legal guest workers, but would force them to leave after six years and re-apply to return. The drafting of such a detailed scheme indicates that President George W. Bush remains determined to push ahead with immigration reform despite the national attention on Hurricane Katrina.


CONCLUSION

What can we conclude about the guest-worker bills that
have been put before the 109th Congress? o All of the bills have some form of Labor Certification to verify that Americans aren't discriminated against when companies want to hire. Unfortunately labor certification is nothing but a charade! We have protections in the law right now, but they are never enforced. I included question #6 to demonstrate the futility of these bills since similar regulations are already in place. None of these bills will do any better than what we have, that is unless the Secretary of Labor has an epiphany and decides to actually do something for American workers instead of pandering to the profit-hungry corporations that demand cheap labor. o All of the sponsors of these bills use their labor certification schemes as "feel good" legislation. These bills have some type of labor certification in order to placate American labor. This allows politicians that sign their names to these bills to claim that the bills protect American workers. It seems that everyone believes in labor certifications except the Department of Labor. o Most of the bills have something to do with national security or terrorism. Read the titles of all of the bills and you will see what I mean. Why don't they have anything to do with protecting the job security of American citizens from the corporate terrorists that are plundering this country? o Government funded internet job registries for the purpose of labor certification are a very bad idea. I know most of you won't shed tears if I say that companies like Dice.com and Monster will probably go out of business if these bills pass, so let me give you another reason: McCain, Kennedy, Kyl, Cornyn, Tancredo, and Bush want to set up a central job database that is run by the Dept. of Labor. What this means is that the government will control who is hired, into what job, and for what salary - for the entire nation. This national job registry is a radical proposal that will give the government to the power control the entire labor market. The Department of Labor will be become the job referral and placement service for the entire nation.

Since mostof you on my mailing list are techies, I really don'tneed to explain why, but if you don't know the risks myprevious newsletters on these guest-worker bills spellout the dangers. - It's probably no coincidence that Tancredo's bill andthe McCain/Kennedy bill have almost identical schemesfor labor certification. Tancredo's bill was originallyproposed in 2002, and was introduced into Congress in2003. So guess where McCain and Kennedy got the ideafrom? Bush's proposal sounds very much like Tancredo'soriginal 2002 bill, so guess where Bush probably gothis idea from? Tancredo's supporters have all sorts ofrationalizations why his bill is a good idea. Mymessage to them is, "Be Careful What you Ask For ...You might just get it." These bills are like canceroustumors that metastasize into bigger and uglier messesthat should be surgically removed before they do moredamage than was intended. Let's take a second look at Tancredo's bill in the 2002draft and the 2005 version. You will see how little thebill has changed, and more importantly how this concepthas perpetuated itself into the other bills:

Ponder this:

Possibly the reason that politicians are racing to get guest-worker bills into Congress is that they plan to slip one into an omnibus spending bill in November. The omnibus spending bill will be necessary to finance the nation's expanding debt load. Omnibus spending bills are excellent opportunities to pass through unpopular legislation without having to vote on a specific bill because the are an up-or-down vote. As an example: the 20,000 increase in the H-1B cap was inserted in last year's omnibus spending bill without public discussion or a vote.

"Guests" Who Never Leave
Historically, there are just two problems with guest worker programs that have been implemented in the United States. ... Congress from those of the past is that they have dropped all pretense that these workers will be here temporarily. Most of the "guest worker" bills now ...
